The Working Project on the Regulations of European and American Chemical Substances Control

The scope and objects of the Chemical Substances legislation are very broad. They are not limited to the regulation of toxic or dangerous chemical substances, but are widely used for cross-domain regulation of known chemical substances. Also, with the control purposes of different laws and regulations, we should design for different levels and orientations. This research project aims to provide a deeper understanding of the coordination and linkage of the legal system of the chemical substance management with other regulations through literature analysis and comparative research, especially for the EU and individual countries (such as Germany, the United States and Sweden). The project has completed the following work items: First, introduce, compare and analyze the legislative intent and scope of the REACH Regulation, CLP Regulation and PIC Regulation. Second, analyze the impacts of REACH Regulation, CLP Regulation and PIC Regulation on the government, business and society. Third, research the correlation between relevant regulations and Seveso Directive III and the circular economy. Forth, observe and compare the legal systems of different countries. Fifth, Propose legislation and amendments to the construction and completeness of Taiwan's Chemical Substance Management legal system. The project also completed two expert and scholar consultation meetings. We focus on the issues about how to construct Taiwan’s Chemical Substance Management legal system. In the meetings, we discussed with the experts and scholars and added their opinions to the report.
